Emergency Temporary Standard (ETS) Update

We make every effort possible to provide our policyholders with current information during the ever-changing COVID-19 pandemic.  Below are the latest developments regarding OSHA’s ETS on COVID-19 vaccinations and testing.

On January 13, 2022, The U.S. Supreme Court issued a stay of Federal OSHA’s Emergency Temporary Standard(ETS) on COV ID-19 vaccination, testing and masking.

As a result, The U.S. Department of Labor’s Occupational Safety and Health Administration is withdrawing the vaccination and testing emergency temporary standard they issued on Nov. 5, 2021, to protect unvaccinated employees of large employers with 100 or more employees from workplace exposure to coronavirus.  This withdrawal was effective January 26, 2022.

Fed OSHA is now going to going to focus on finalizing a permanent COVID-19 Healthcare Standard.

The Supreme Court ruling does not impact State Specific ETS requirements such as Cal OSHA’s COVID-19 Prevention Emergency Temporary Standards (ETS), which was effective January 14, 2022.
